Capobian Posted December 21, 2012 Report Share Posted December 21, 2012 Hey Folks, Is it possible (read legal) to incrementally fund a construction contract with a performance period of less than 6 months? My gut says no since it's non-severable, but I wanted to reach out to the community to get other opinions. You are not going to find any official document that says it's illegal to incrementally fund a construction contract with a performance period of less than six months. Some supplements do place sideboards on incremental funding and might even mention construction specifically. You will most likely find the discussion, if any, in the agency supplement to FAR 32.7.
