An urgent and compelling language interpretation contract (under SAT) was awarded to a vendor whose quote included administrative and project management services not listed as a CLIN in the RFQ or Contract. The RFQ and Contract stated the rate for interpretation shall be fully burdened. The PWS included terminology for Project Manager. Now the vendor is invoicing separately for administrative and PM fees. Any advice on a resolution to this situation? Vendor has been advised to revise the invoices to remove the amin rates but continues to include them.

A lot more information is needed for a response including language in your RFQ and the vendors response. But I’ll say generally when people speak of a fully burdened rate, that just means labor, benefits if not included in overhead, overhead, G&A, and profit. It usually does not mean bundling other labor like administrative and project manager in it. But we need to see what your RFQ said.

If you want a single rate to include all labor categories such as administrative and project manager in support of the interpreter, the most common method is to specify the submission of a composite rate for interpretation services.

Without knowing the details—that I don’t want—the government issued a RFQ. In turn, the seller provided a quote. In the end, the government issued an ‘offer’, which the seller ‘accepted’ to form a ‘contract’.

Go study offer and acceptance. Was there a meeting of the minds or some defect in the process? If there was a defect, what are the consequences or remedies?
