The Gov't customer is withholding payment of invoices due to a missing deliverable. This contract is about the resell of a software product. No services involved. Is there a way to resolve this issue so we may receive payment? Thank you.

Apologies, additional information: the resale of the products POP didn't match the Gov't contract POP which is an issue when it comes to a software product. The Gov't POP is 29 September 2023 to 28 September 2024. The software vendors didn't deliver products until Feb 2024, so we didn't receive payments until Feb 2024

Are you sure your dates are correct because Feb 2024 is well within the Period of Performance you specified (29 Sept 2023 to 29 Sept 2024).

Second, it's nearly impossible for anyone here to assist you without access to the contract and all the facts. In my opinion, you should hire an experienced government contracts attorney.

Contractor, is the contract one for commercial products with FAR 52.212-4?  If it is not for commercial products, how is the contract priced, e.g., cost reimbursement, FFP etc.?  Also, I agree with H2H your facts are unclear.

Fixed price Government contracts usually do not require the Government to pay for deliverables that are missing.
