Can anyone tell me the criteria for protesting a task order award under an IDIQ? Does it depend on the Agency? If so, let's use DOT as an example. I believe the task order award being disputed must have a value of $10M in order to protest. Direct me to the FAR clause or other guidance on this matter so I calm our PM's down.

From FAR 16.505(a)(9):

i) No protest under Subpart 33.1 is authorized in connection with the issuance or proposed issuance of an order under a task-order contract or delivery-order contract, except for?

(A) A protest on the grounds that the order increases the scope, period, or maximum value of the contract; or

( A protest of an order valued in excess of $10 million. Protests of orders in excess of $10 million may only be filed with the Government Accountability Office, in accordance with the procedures at 33.104.

(ii) The authority to protest the placement of an order under this subpart expires on May 27, 2011. (10 U.S.C. 2304a(d) and 2304c(d), and 41 U.S.C. 253h(d) and 253j(d)).

What happens after May 27th?

Unless Congress extends it, the ability to protest goes away.

2011 NDAA extended the sunset date for Defense Agencies until 2016.

HR 899 and S 498 are looking at doing the same thing for civilian agencies.
