SEC. 821. REVISION OF PROOF REQUIRED WHEN USING AN EVALUATION FACTOR FOR EMPLOYING OR SUBCONTRACTING WITH MEMBERS OF THE SELECTED RESERVE.

Section 819 of the National Defense Authorization Act for Fiscal Year 2006 (Public Law 109-163; 119 Stat. 3385; 10 U.S.C. 2305 note) is amended--

(1) by striking subsection (b); and

(2) by redesignating subsection (c) as subsection (b).

Revision of proof required when using an evaluation factor for employing or subcontracting with members of the Selected Reserve (sec. 821)

The Senate amendment contained a provision (sec. 843) that would modify section 819 of the National Defense Authorization Act for Fiscal Year 2006 (Public Law 109-163) to
remove a documentation requirement that is unnecessary given the solicitation requirements established under subpart 15.203 of the Federal Acquisition Regulation.

The House bill contained no similar provision.

The House recedes.


Senate Committee Report 116-236 to Accompanying S. 4049


Revision of proof required when using an evaluation factor for defense contractors employing or subcontracting with members of the selected reserve of the reserve components of the Armed Forces (sec. 843)

The committee recommends a provision that would modify section 819 of the National Defense Authorization Act for Fiscal Year 2006 (Public Law 109-163) to remove a documentation requirement that is duplicative of solicitation requirements established under subpart 15.203 of the Federal Acquisition Regulation. The committee appreciates the Department of Defense's continued attention to regulatory reform efforts and notes that this change is based on a recommendation from the Department's Regulatory Reform Task Force.
