  1. what is anyone's position on how long the period of performance on a CLIN can be for severable service CLINs I'm receiving guidance that POPs cannot be longer than 3 years since that is the period of availability of the funds the agency receives. And that fiscal law is being violated due to bona fide needs rule. I specifically track how funds are used and expended and believe I am not violating fiscal law. while I understand the rules of Severable Service Contracts and limits on POPs I do not understand why that limits the pop on a CLIN. Per the rules : The POP must begin in a FY in which the funds are available for obligation If the POP on the contract vehicle is fully within the fiscal year(s) in which the funds are available for obligation, the POP may extend the entire period of availability If the POP on the contract vehicle extends beyond the fiscal year(s) in which the funds are available for obligation, the end date of the POP on severable contract vehicles is constrained under law by the 12 month rule
  2. can someone point me to articles to read about COIVD and Fixed price CLINS- some work was not completed due to the inability of the contractor to access govt facilities and increased storage costs - some articles I've read based on recent cases suggest increased storage costs are not recoverable in FP CLINS, even during COVID and just would like to read about other school of thought.
  3. the vendor is proposing hours against the requirements and that is how we negotiate the estimated cost not sure about the comment related to hours. Yes the estimated cost is what goes in the contract. if its a completion clin , all of the fee is not provided until the work is done is my understanding . If its LOE , they get all of the fee whether the work is not completed , is also my understanding
  4. Hello. I have completed an RFP for a CPFF Completion CLIN for software development and submitted to the vendor . We are in a sole source environment. The vendor has responded with a proposal with X amount of hours and dollars ; which was expected. Additionally, the vendor is stating they need a number of LOE hours for "Management " ( not program mgmt ) moreso, " Technical Leadership". I feel the vendor is attempting to force us into a CPFF LOE CLIN; which this is not. in the same response - they also stated they proposed a "percentage of FTE" when it comes to this Technical Leadership concept. I have no idea what a percentage of FTE means and it does not make sense when this is a completion effort. I just expect them to propose the number of hours based on the requirements. My plan is to inform them to only propose the hours necessary to complete the requirements. what are you thoughts
