You cannot chose anything that is expressly required by statute, but you can chose some implementation of statute that is not expressly required. It is the most anticompetitive rule anyone could come up with and it is not statutory. It goes far beyond any rational requirement of 15 U.S.C. 631(a). It is nothing but a troublesome political sop written by lazy people in OFPP. There must be a better, more rational way to ensure that small businesses get a piece of the action.
