SMALL BUSINESS DETERMINATION

AS WE OBTAIN THE BUSINESS SIZE OF VENDORS WE HAVE USED UNDER OUR PRIME, DO WE PROVIDE THE NAICS CODE THAT WAS IN THE ORIGINAL SOLICIATION OR LET THE VENDOR DECIDE WHAT NAICS APPLIES TO ITS BUSINESS AND ADVISE US OF ITS SIZE. FOR EXAMPLE, IF THE PRIME SOLICIATION REFERENCED NAICS CODE 541990 OTHER PROF. SCIENTIFIC, TECH. SERVICES AND WE USED A SUB THAT WAS NOT PART OF THE ORIGINAL TEAM THAT PROVIDES THE MAJORITITY OF ITS SERVICES 541710 ENGINEERING SERVICES. WHAT CODE IS USED FOR THE VENDOR TO CONFIRM ITS SIZE TO US?

May I suggest that you not type in ALL CAPS? It appears as if you are shouting when you do so. I am confused by your question. Who is "we"? Are you a Government contract specialist or a prime contractor? Your profile is incomplete. Are you wondering whether subcontractors are required to be listed in the CCR and use the same NAICS code that you used in to procure the prime contractor?

? 121.410 What are the size standards for SBA's Section 8(d) Subcontracting Program?

For subcontracting purposes pursuant to sections 8(d) of the Small Business Act, a concern is small for subcontracts which relate to Government procurements if it does not exceed the size standard for the NAICS code that the prime contractor believes best describes the product or service being acquired by the subcontract. However, subcontracts for engineering services awarded under the National Energy Policy Act of 1992 have the same size standard as Military and Aerospace Equipment and Military Weapons under NAICS code 541330.
