REA - Request for Equitable Adjustment

Contract Type: FFP, IDIQ

Years after the basic contract was awarded, the fees have increased that affected the pre-priced ELINs. The KTR did not notify the Govt of this price increase until a request for equitable adjustment has been submitted to pay for the difference in order to complete a final deliverable of a task order (issued under the basic contract). 

Will the KTR's failure to notify the Govt on the increased fees impact the award of the REA mod? In addition, if the basic contract is already expired, can this REA mod still be funded? (POP of Task Order has been extended for this pending REA/final deliverable.)

The first question is this: What provision in the FFP ID/IQ provides for a price adjustment due to a “fee increase” (and what is the “fee”)? Can you quote the contract language? Thanks.

If a task order is still open for fulfillment, the basic contract is not “expired”. Only the ordering period has “expired”. All terms and conditions of the basic contract that apply to the task order should still be effective.
