Request for Equitable Adjustment

REA

Recommended Posts

if a Contracting Officer extends the contract for 6 months but the contractor incurs costs far exceeding prevailing rates, such as higher labor, rent, etc.  does the Contracting Officer pay that whole amount or must the company lose money?   Is obtaining the funds done through an equitable adjustment?

Since you gave so little information, one must make assumptions to answer your questions.  Based on my reasonable assumptions, the contractor is not entitled to any increase in the contract price, and any and all costs incurred by the contractor are wholly the contractor's responsibility.

If you don't like the above answer, please provide some basic information, such as--

  • Is the contract for supplies or services?
  • Is the contract fixed-price, cost-reimbursement, or time-and-materials?
  • Was the extension done by unilateral or bilateral contract modification?
  • What was the reason for the extension modification?  What authority was cited in block 13 of the SF-30?
