Service Contract Compliance

ALLCON:

I have a Service Contract Act compliance issue. The Davis Bacon Act (DBA) requires frequent certifications by the contractor that it is in compliance with the DBA.

But does a contractor that is subject to the SCA (either by the terms of the contract or the mere fact that the SCA applies to it) have to make any certifications to the Contracting Officer of Government that it is in compliance with the SCA? If so, by what authorit (e.g., the Contract, the FAR, DFARs, DoL regs, the Service Contract Act, other).

No specific certifications required but a CO has the authority to determine if compliance is occurring as is the case for every contract term and condition. In doing so the CO might ask for specifics to determine a contractors compliance. Issues of suspected non-compliance that are in conflict between the CO and the contractor are submitted to the DOL for final determination and possible enforcement action.
