Recommended Posts

A district court judge on Monday night issued a preliminary injunction freezing the Obama administration’s Fair Pay and Safe Workplaces FAR Rule that was to have taken effect on Tuesday:

This is getting interesting. OFPP issued a memo shortly after this decision that stated:

Quote

The Court Order does not enjoin implementation of those sections of, or the clause in, the FAR rule addressing the paycheck transparency requirements in the E.O. (i.e., section 5 of E.O. 13673), including FAR 22.2005, 22.2007(d), and clause 52.222-60.  This coverage will take effect for new solicitations issued on or after January 1, 2017, as stated in the final rule.

However, neither the HTML or PDF versions of the FAR on the Acquisition.gov site have been updated to include the new FAR subpart 22.20. However, the new subpart is contained in its entirety in the e-CFR, which is not an official legal edition of the CFR. Now what?
