djrapoza
I am working on my first Termination for Default on a construction contract. The Government incurred some damages due to the default, i.e. damages such as having to take emergency protection measures on our building that was being sided since the default occured in the winter on the rainy Oregon Coast, and the building would have sustained water damage. We also plan to reprocure against the Contractor's account. Do I send two seperate demands for payment - one for other damages, and one for reprocurement costs, or can it all be rolled into one demand? charles
How do you reprocure against the KTR's account? Before sending any demands have you provided the appropriate notices to the KTR and surety? And what is your percentage of completion?
Guest Vern Edwards
IDo I send two seperate demands for payment - one for other damages, and one for reprocurement costs, or can it all be rolled into one demand? You don't have to send two separate requests, but you should itemize all demands.
